Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Friday Numbers website and service ("Service") operated by Friday Numbers ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Friday Numbers, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Friday Numbers is a weekly team accountability tracking platform. Team members submit check-in responses every Friday, and the Service calculates scores, tracks streaks, surfaces trends, and provides dashboards and reports to help teams stay accountable.

We may update, modify, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of significant changes.

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your password
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may not share your login credentials with others or allow multiple people to use a single account. Each team member must have their own account.

4. Free Trial and Billing

Free Plans. We offer a free Starter plan with limited features. No payment information is required to use the free plan.

Free Trial. Paid plans include a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.

Billing. Paid subscriptions are billed monthly in advance through Stripe. All prices are listed in US dollars and are subject to applicable taxes. By providing payment information, you authorize us to charge your payment method on a recurring basis.

Auto-Renewal. Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused portions of a billing cycle.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Scrape, crawl, or use automated tools to extract data from the Service without permission
• Share your login credentials with unauthorized users
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit malicious code, viruses, or harmful content
• Use the Service to send spam or unsolicited communications
• Impersonate another person or entity
• Reverse engineer, decompile, or attempt to extract the source code of the Service

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these acceptable use terms.

6. Intellectual Property

The Service, including its design, code, logos, trademarks, and content (excluding your data), is owned by Friday Numbers and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

7. Data Ownership

Your data is yours. You retain all ownership rights to the data you submit to the Service, including check-in responses, scores, coaching notes, and organization information. We do not claim any intellectual property rights over your data.

You grant us a limited, non-exclusive license to use your data solely to provide and improve the Service. This license ends when you delete your data or close your account.

You can export your data at any time in CSV format from your account settings. If you delete your account, we will delete your data within 30 days, except where retention is required by law.

8. Service Availability

We use commercially reasonable efforts to keep the Service available and operational. However, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to provide advance notice of planned maintenance that may result in extended downtime. We are not liable for any loss or damage arising from service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRIDAY NUMBERS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Termination

By You. You may cancel your account at any time from your account settings or by contacting us at [email protected]. Upon cancellation, your access to the Service will continue until the end of your current billing period.

By Us. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if your account has been inactive for an extended period. We will make reasonable efforts to notify you before termination, except where immediate action is required to protect the Service or other users.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination to allow you to export it, after which it will be permanently deleted.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of Maine.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
